Overview
GARTH A. SPENCER is a partner in the Los Angeles office of Glancy Prongay Wolke & Rotter LLP. He represents investors in securities fraud class actions, and also represents consumers harmed by corporate misconduct.
Since joining the firm in 2016, Garth has taken leading roles in securities class actions against companies in aerospace, electric vehicles, and energy. His representative recoveries include:
- Li v. Spirit AeroSystems Holdings, Inc., No. 1:23-cv-03722 (S.D.N.Y.): $29.2 million settlement
- In re XL Fleet Corp. Securities Litigation, No. 1:21-cv-02002 (S.D.N.Y.): $19.5 million settlement
- In re Reconnaissance Energy Africa Ltd. Securities Litigation, No. 1:21-cv-06176 (E.D.N.Y.): CAD $9.425 million settlement for the U.S. class
- In re Mullen Automotive, Inc. Securities Litigation, No. 2:22-cv-03026 (C.D. Cal.): $7.25 million settlement
In Spirit AeroSystems, the court appointed the firm and its co-counsel to lead the case on behalf of investors, finding them “well qualified to serve as class co-counsel.” Investors alleged that Spirit concealed production-quality problems affecting parts it supplied for Boeing’s 737 MAX. After plaintiffs filed two amended complaints and Spirit moved to dismiss, the parties reached a $29.2 million settlement, which the court approved in January 2026.
In XL Fleet, where the firm served as lead counsel, the court denied the defendants’ motion to dismiss in its entirety. The case then went through extensive discovery, including roughly 120,000 documents produced by the defendants and depositions of all six individual defendants, before settling. In ReconAfrica, also as lead counsel, the firm defeated a motion to dismiss. It then negotiated a coordinated cross-border settlement that resolved parallel U.S. and Canadian class actions.
Before joining the firm, Garth represented IRS whistleblowers as a sole practitioner and practiced in the tax group of a large law firm. He earned his J.D. from Duke University School of Law and an LL.M. from New York University. He is admitted to practice in California, New York, and North Carolina.
